In 2016, a Californian woman by the name of Anastasia Ashley claimed she was discriminated against by a restaurant, who she alleges, refused to serve her because of her outfit.

A photo of a pro-surfer in jean-shorts and a sheer top has made waves for an upscale Newport Beach restaurant. Anastasia Ashley posted on Instagram in March 2016 a photo of her wearing those shorts and claimed she was discriminated against by Gulfstream restaurant because she was told her shorts were too short.

She wrote in her post: “My shorts aren’t too short and I think as a woman I can choose the shorts I want to wear and I don’t need a restaurant to dress me and tell me what is appropriate or not.” The professional surfer from San Clemente had ridden a wave of attention on social media with hundreds of comments, both in support and in backlash.

CBS News had taken to the streets to get the opinion of the public. “She looks tasteful she looks stylish. There’s nothing wrong with what she’s wearing,” one Sarah Cameron said.

Another, Celeste Brill, said: “I just don’t think it’s appropriate, especially like in restaurants where people are eating and stuff. Kids could maybe walk in.”

On the restaurant group’s website, part of the attire policy had initially read: “For men and women, we request you avoid beachwear or activewear that is overly revealing.”

Now, presumably because of this high-profile incident, it has been changed to: "We consider hats, tank tops, flip flops, and team athletic attire too casual for our restaurant." There is also a full list of dining guidelines available on the restaurant group's website.

CBS News had spoken with the general manager, who acknowledged that Ashley was asked to cover up because of her clothing and that she complied and seemed happy.

According to him, there was no discrimination, and she was never asked to leave. Ashley was unable to do an interview with CBS but did respond via email saying that while she understands the concept of a dress code, she still believes her attire was appropriate for lunch near the beach.
