Cops stop us for many reasons and some reasons aren’t as obvious as others. As a result of these stops, they can easily escalate to a situation where the cop insists that he or she smells something odd in your car. Maybe you are now being targeted because of the color of your skin or your race. You have given rights that should be exercised when placed in these difficult situations with cops. 1. Using the simple phrase “Am I now free to go?”

Whenever you are in the company of police you can utilize this phrase. This phrase can be asked in a variety of ways. Some choose to ask, “Are you detaining me?” As a result of asking this question, police are required to let you go if they have no reason to hold you. If police inform you that you are not free to go, they are most likely expecting something from you and will do their best to get it. If cops succeed in getting you to say or do something incriminating they will have succeeded and will now have a reason to detain you.

2. You do not have my permission to search.

The law enforcement can be tricky and will try to convince you to allow them to conduct a search in your car or your home. Some may say that if you are innocent and have nothing to hide, conducting a search shouldn’t be a problem. Some even go as far as to say that they will be much easier on you if you allow them to search your home or car. Even if you are innocent, hold on to your rights. There are many questions that a cop can ask to get you to let them in. Never give up your rights.

3. Choose to stay silent.

Remaining silent is your right. If you are in a situation that is getting worse with every response you give, use the right to remain silent. A cop may inform you that you were stopped for speeding. As a result of you opening your window they picked up the scent of marijuana. If you were smoking you may be tempted to say that you were driving while your friend was smoking in the passenger seat. In this case, the cops have got you.

4. I need a lawyer.

If you get to the point of feeling like you need a lawyer, then you are probably already in a bad position. Getting a lawyer is a must. Inform the cop that you would like a lawyer and say no more until your lawyer gets there.

These four rights are yours to use whenever you may need them. When you are facing cops, it may be hard to use them.
