38-Year-Old Woman Sues After IVF Error Led Her To Carry & Deliver Stranger’s Baby

Krystena Murray, a single woman, filed legal action after an alleged error during an in vitro fertilization (IVF) procedure led to her carrying and delivering a child that was not biologically hers. As detailed in a complaint filed in a Georgia court, Murray turned to Coastal Fertility Specialists for assistance in becoming a parent.

IVF is a widely used medical procedure that helps individuals and couples conceive by fertilizing an egg outside the body before implanting it into the uterus. The process has brought hope to many aspiring parents but requires precise handling to ensure that embryos are correctly matched to their intended recipients.

In May 2023, the clinic reportedly implanted an embryo in Murray, resulting in her pregnancy. However, the complaint alleged that she unknowingly carried an embryo belonging to another couple who were also undergoing treatment at the same facility.

The legal filing in the State Court of Chatham County, Georgia, cited by the Associated Press, stated that Murray, identified as a “fair-skinned, White woman,” had specifically chosen a sperm donor who resembled her in appearance. She gave birth on Dec. 29, 2023, expecting to meet her biological child. Instead, she was confused and afraid when she realized something was amiss.

As outlined in the complaint, Murray’s newborn was described as a “dark-skinned, African American baby.” While she had “no issues or concerns with the Baby’s race,” she immediately recognized that there was no biological connection between them, a realization that left her feeling “terrified and shocked.”

Despite this revelation, Murray’s love for her child remained unchanged. Still, she sought clarity on what had occurred. In January 2024, she took an at-home DNA test, which confirmed her suspicions. The following month, her attorney contacted the fertility clinic for answers regarding the apparent mix-up.

According to the complaint filed in March 2024, Coastal Fertility Specialists “surmised” that they had mistakenly implanted an embryo in Murray that belonged to an unrelated couple. This couple later pursued legal action against Murray for custody of the child. A subsequent DNA test allegedly confirmed their biological connection to the baby.

Faced with the brutal reality of the situation, Murray ultimately chose to voluntarily relinquish custody in May 2024, hoping to prevent further hardship for the child. Since that time, she has not seen him. In her statement, she expressed the emotional toll of the experience, saying it “has destroyed me.”

She went on to describe her devastation:

“Nothing can express the shock and violation upon learning that your doctor put a stranger’s embryo into your body. To carry a baby, fall in love with him, deliver him, and build the uniquely special bond between mother and baby, all to have him taken away. I’ll never fully recover from this.”

Coastal Fertility Specialists addressed the situation in a statement to NBC and The Washington Post, referring to the incident as an “isolated” case in the clinic’s 15-year history, asserting that “no further patients (were) affected.” The clinic acknowledged its role in the mix-up:

“Coastal Fertility Specialists deeply regrets the distress caused by an unprecedented error that resulted in an embryo transfer mix-up.” 

“While this ultimately led to the birth of a healthy child, we recognize the profound impact this situation has had on the affected families, and we extend our sincerest apologies,” it continued.

Following the incident, the clinic claimed to have conducted a comprehensive review, implemented additional safeguards, and was “doing everything we can to make things right for those affected by this incident.”

Murray’s case highlighted the devastating consequences that can arise from errors in fertility treatments and raised concerns about the safeguards in place at IVF clinics. As Murray continues to seek justice, her story underscored the need for stricter protocols to prevent similar tragedies from happening to other families.
